DashKeep Pre-Order Terms of Service

1. Agreement to Terms

By pre-ordering DashKeep, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not pre-order or use the service.

2. Pre-Release Software

• 2.1 No Feature Guarantees: DashKeep is a pre-release product. We make no guarantees regarding the inclusion, exclusion, or final form of any features described during the pre-order period.
• 2.2 Good Faith Statements: All statements regarding planned features, timeline, and product capabilities are made in good faith and are presumed accurate based on our current plans at the time of writing. Plans may change without notice.
• 2.3 No Liability: You acknowledge that features, functionality, and release dates may change. DashKeep shall not be liable for any changes to, delays in, or cancellation of planned features.

3. Lifetime Licence and Licensing Terms

• 3.1 Lifetime Licence: A pre-order purchase gives you a lifetime licence of local software. You can use the software under the licence terms perpetually as permitted under the GNU General Public License v3.0.
• 3.2 Per Camera Licensing: Each purchase is given on a per camera basis. Multiple cameras require separate purchases for each additional camera.
• 3.3 Access to Source Code: Upon fulfillment of your order, you will receive access to the GitLab code hosting platform. You are welcome to collaborate as you would with any other open source project.

4. GNU General Public License v3.0 and Additional Terms

The DashKeep software has elements licensed under GNU General Public License v3.0. Software distributed under these terms is clearly marked. All software distributed under the GPLv3 has these additional terms added per section 7 of the GPL:

• 4.1 Trademark Restriction: You cannot use the "DashKeep" trademark to represent any modification, if distributed separately or as a commercial product. You should make it clear that it is a "Fork" of DashKeep, with no warranty.
• 4.2 Attribution Requirement: The attribution must be stated as follows, at the top of any attached readme file: (c) DashKeep Inc. This software costs money. Please support continued development by purchasing this software at dashkeep.io.
• 4.3 AI Training Restriction: The code cannot be used to train commercial AI models where the subsequent generated code is not licensed under the GPLv3.

5. Pre-Order Refund Policy

Pre-orders are fully refundable in the following cases:

• 5.1 Fraudulent or Unpermitted Transactions: Refunds will be provided for fraudulent or unpermitted transactions.
• 5.2 Non-Fulfillment After 24 Months: After 24 months from the date of your order, if the order for the software is not fulfilled as described, you may request a full refund.

6. Access to Software

• 6.1 GPL Licensing Begins Upon Receipt: Licensing under GPLv3 begins once you receive the software from us.
• 6.2 No Pre-Release Source Code: You cannot request source code prior to the release of the product.

7. Waitlist Discount Terms

• 7.1 Discount Code Delivery: If you are on the waitlist, you will have received via email a unique discount code. You must apply this at checkout to obtain your discount, within the timeframe provided.

• 7.3 One Redemption Per Customer: Maximum one redemption per customer. If you redeem more than once, we may retroactively remove the discount.

8. Referral Program

• 8.1 Referral Period: During a specified period, we may allow (with your consent) third parties to enter your order email address, alongside a referral code at checkout in order to claim a qualifying discount.
• 8.2 Eligibility: A minimum of 30 calendar days after the successful pre-order, you may be eligible for a financial incentive, as specified by the terms of the specified period.

• 8.3 Payment Methods: You may receive accumulated financial incentives via:

  - Bank wire

  - PayPal transfer

  - Cryptocurrency transfer (subject to availability)

  - Reverse credit/debit card transaction

• 8.4 Minimum Transfers and Fees: There may be minimum transfer amounts for each method. We will contact you to inform you of successful referrals. Your compensation will be less any transfer fees or costs, which will be communicated to you.
• 8.5 Advertising Compliance: You must comply with local advertising laws, including disclosing that you will receive a commission for the referral.

9. User Conduct

You agree not to:

• 9.1 Use automated tools or scripts to access or interact with the pre-order system.
• 9.2 Use the pre-order system for any unlawful purpose or in violation of any applicable laws.
• 9.3 Harass, abuse, or threaten DashKeep staff or other users.
• 9.4 Misrepresent your identity or provide false information during registration.

10. Limitation of Liability

To the fullest extent permitted by law, DashKeep shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your pre-order or participation, including but not limited to loss of profits, data, or goodwill.

11. Disclaimer of Warranties

DashKeep provides the pre-order on an "as is" basis without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Privacy

Your use of the pre-order system is subject to DashKeep's Privacy Policy, which is incorporated by reference into these terms.

13. Modifications to Terms

DashKeep reserves the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the pre-order system following any changes constitutes your acceptance of the revised terms.

14. Termination

DashKeep reserves the right to cancel your pre-order at its discretion, including for violation of these terms, fraudulent activity, or any reason deemed appropriate. In such cases, a full refund will be provided.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales, excluding any conflict of law principles.
